Terms of Service
These Terms of Service govern your use of the website and the digital course "Beyond the Rules" (the "Course"), a chess course for players rated 1200 Elo and up. By accessing the site, purchasing the Course, or using it, you agree to these Terms. If you do not agree, do not use the site or the Course.
Your use of the Course is also subject to our Privacy Policy and our Refund Policy, which form part of this agreement.
1. Who may buy and use
You must be at least 18 years old and have the legal capacity to enter into a binding contract where you live. By purchasing or using the Course you confirm that you meet these requirements. If you are a minor, use is permitted only with the consent of a parent or guardian and under their responsibility.
2. What the Course is
"Beyond the Rules" is a digital product: an online chess course with principles, rules, live-board puzzles, a practice arena and a lexicon of terms. Access is provided through the website only, and does not include downloadable files or installable software. What you buy is a personal license to use the content, not a sale of the content itself.
3. Purchase, price and subscription
The Course is sold as a yearly subscription. The launch price is $12 per year (instead of $29). At the end of each year the subscription renews automatically for another year, at the price shown on the site at the time of renewal, unless you cancel first. You can cancel at any time through the Lemon Squeezy subscription-management link on your receipt and renewal emails, or by writing to us at noambbb@gmail.com. Cancellation stops the next charge, and access continues to the end of the period already paid for. A price change never applies to a period already paid for.
Payment, invoicing and the collection of VAT or sales tax are handled by Lemon Squeezy, acting as the Merchant of Record for the transaction. This means Lemon Squeezy is the party that charges you and issues the financial document, under its own terms and privacy policy.
3A. Free access and the beta period
Alongside paid purchases, we may grant free access to the Course, for example to beta participants, reviewers and invited guests. Free access differs from a purchase in three ways: nothing is paid for it, it is limited in time, and it does not carry the renewing subscription that a purchase does.
Beta access is granted for the beta period only. When that period ends, access ends automatically, and we do not undertake to extend it or to convert it into full access. The exact end date is shown at all times on your account page, together with the number of days remaining, and that is how you can tell when your access closes. If you would like to continue after the beta, you are welcome to buy the Course at the price then in effect.
Because nothing was paid for free access, the refund policy does not apply to it and there is no right to a refund in respect of it. We may end or withdraw free access at any time at our discretion, in particular if these Terms are breached. During the beta the Course may still change, and parts of it may be added, corrected or removed. You are under no obligation to give feedback, and if you do give feedback we may use it to improve the Course, without payment and without identifying you by name.
4. Passwordless sign-in
Signing in to the Course is passwordless. You enter an email address, and we send it a one-time sign-in link and a 4-digit code. Clicking the link, or typing the code, signs you in. We do not store passwords. You are responsible for keeping access to your email inbox secure, since anyone with access to it can sign in to your account. 5. Acceptable use
When using the Course, you agree not to:
- Share your sign-in link, code or account access with anyone else, or let another person use your access;
- Copy, bulk-download, reproduce, distribute, publish, resell or make the Course content publicly available, in whole or in part, beyond your own personal viewing;
- Bypass, disable or interfere with the sign-in mechanism, the entitlement check or any security measure on the site;
- Use the site or the content in any way that breaks the law or infringes the rights of others;
- Overload, scan or disrupt the normal operation of the site with automated tools.
6. Intellectual property
All rights in the Course content, text, puzzles, graphics, code and the "Beyond the Rules" trademarks are owned by us. You receive a personal, limited, non-exclusive and non-transferable license to view and use the content for your own study only, for the duration of your access period. Nothing in these Terms transfers any ownership of the content to you.
7. Right of cancellation and refund
We offer a full money-back refund within 30 days of purchase, no questions asked. The full details are in our Refund Policy. Please read it before buying.
8. Suspension and termination of access
We may suspend or terminate your access to the Course if:
- You materially breach these Terms, for example by sharing your access with others;
- Your payment is reversed, refunded or not received;
- We are required to do so by law or by a competent authority;
- We have reasonable grounds to believe the account is being used fraudulently or without authorization.
Termination affects only your future access to the content. If your access ends through no fault of your own, we will refund the proportionate part of your payment or offer another reasonable remedy.
9. Service availability
We aim to keep the site highly available, but we cannot guarantee that the service will run without interruption or fault at every moment. There may be downtime for maintenance, updates or reasons beyond our control. A temporary, reasonable outage is not a breach of this agreement by us.
10. Limitation of liability
The Course is provided "as is" and "as available". To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, and in any case our total liability to you will not exceed the amount you paid for the Course. None of this limits any non-waivable rights you have under the consumer protection law that applies to you.
11. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. If a change is material and affects your existing access, we will notify you by email. Continued use of the Course after the change takes effect constitutes acceptance of the updated Terms.
12. Governing law and jurisdiction
These Terms are governed by the laws of the State of Israel, and the exclusive jurisdiction lies with the competent courts of the Tel Aviv district. If you are a consumer whose local consumer protection laws apply to you, nothing here deprives you of the protection of those laws.
